Glad to see people are looking at this and trying to help. I'm not looking for a "discussion" here...I didn't give you the "long story" because its irrelevant to what I'm looking for. Since you asked, the dealer recommended and I agreed on 10k, since I told him I could have a 1500 lb trailer with a 1000 lb load. Then they gave me a 7000 lb tag by mistake. In their defense it was a Honda dealer, not a truck dealer. Now that I know I could even blow 10k, I have since bought 13000 lb registration. Anyway, the dealer did send a letter affirming their mistake, I'm sure that's the only reason the judge agreed to listen to me. This meets all the policy criteria for warning ticket, vs citation, as per the NC general statutes (20-183 section B), which is my defense. I'm not arguing that I wasn't overweight, just that the circumstances did not warrant punitive action. The judge seemed ready to dismiss on that basis until the state's attorney claimed that officers are prohibited from giving warning tickets for "statutory" matters. As you can imagine, I protested this was not true, so then she gave me 30 days to prove that warning tickets can be issued for overweight violations. Several NCSHP personel have verified that warnings can be given for any type of violation, but of course are unwilling to look for or share copies. So there's no real need to make this all long winded, I'm just looking to see if I can dig up proof that someone, somewhere ever got a warning ticket for an overweight violation. Thanks again for helping, if you can.
I'd prefer NC respondents, no offense, Tex, but unless you got stopped in NC, it won't help me. As for the where/when, etc from above, it was Apr 09, in Wilkes County.
